Terms of Service

1. Acceptance of Terms

By accessing or using BookWith ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including service providers ("Providers") and customers ("Customers").

2. What BookWith Is

BookWith is a technology platform that provides:

• An automated receptionist service that answers calls on behalf of Providers
• A booking management system
• A marketplace where Customers can discover and book Providers
• SMS reminder and confirmation services

BookWith is a technology intermediary. We do not employ Providers, provide services ourselves, or guarantee the quality of any service arranged through our platform.

3. Provider Accounts

Providers must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account. You must be the legitimate owner or authorised representative of the business you register.

Providers agree to:

• Provide services as described in their profile
• Honour bookings made through the platform
• Maintain accurate availability information
• Respond appropriately to customer concerns
• Not use BookWith to facilitate illegal activity

4. Subscriptions and Billing

BookWith subscriptions are processed through Gumroad. By subscribing, you authorise recurring charges at your chosen billing frequency. All prices are in USD unless otherwise stated.

The $5 trial provides 7 days of full access. After the trial period, your chosen subscription rate applies automatically unless you cancel before the trial ends.

Cancellation takes effect at the end of your current billing period. No partial refunds are issued. Please see our Refund Policy for full details.

5. Prohibited Uses

You may not use BookWith to:

• Create fake business profiles with no intention of providing services
• Collect bookings or deposits without intending to fulfil them
• Harass, threaten or abuse customers or other providers
• Engage in any fraudulent, deceptive or illegal activity
• Create multiple accounts to abuse the free trial
• Attempt to reverse-engineer, scrape or otherwise compromise our systems
• Violate any applicable laws or regulations

Violation of these terms results in immediate account suspension and potential legal action. Please see our Acceptable Use Policy.

6. Limitation of Liability

BookWith is provided "as is" without warranty of any kind. We do not guarantee uninterrupted service availability. To the maximum extent permitted by law, BookWith's liability is limited to the amount you paid for the service in the 3 months preceding any claim.

We are not liable for: loss of bookings due to service interruption; disputes between providers and customers; the actions or omissions of any provider or customer; indirect, consequential or punitive damages.

7. Disputes Between Providers and Customers

All disputes regarding the quality, delivery or payment for services are between the Provider and Customer directly. BookWith is not a party to these disputes and has no obligation to mediate or resolve them. We may provide contact information to assist parties in resolving disputes directly.

8. Intellectual Property

BookWith and its content are owned by BookWith and protected by copyright and trademark law. You may not reproduce, distribute or create derivative works without our express written permission.

9. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the new terms.

10. Governing Law

These terms are governed by applicable law. Any disputes will be resolved through binding arbitration or the courts of the jurisdiction in which BookWith operates, as applicable.
